Case Facts: The accident occurred when a tractor-trailer attempted to pass Plaintiff’s
vehicle on the left side and drifted into Plaintiff’s lane, striking
her vehicle. Plaintiff brought suit against the commercial vehicle’s
driver and its owner.
Plaintiff was caused to suffer a herniation of her C5-6 disc. She exhausted
all conservative treatment that included physical therapy and epidural
injections of steroid-based painkillers. Our client eventually had to
undergo surgery that included multiple level cervical discectomies and
fusions. She also had to continue with physical therapy post-surgery.
The defendant in this case claimed that Plaintiff’s cervical condition
was a degenerative condition that predated the accident.
The jury found that the defendants were liable for the accident and awarded
Plaintiff $2,000,000.00 for pain and suffering. The case was handled and
