Case Facts: Our client was a pedestrian crossing Route 28 at night, outside of a crosswalk near the traffic light by the Kingston Nissan dealership. After crossing three lanes of traffic, she was struck by the defendant driver. Our client suffered multiple serious injuries, including 4th and 5th rib fractures, endplate fractures of her thoracic spine at the T5-T6 level and a T5 compression fracture. During the litigation, the defense was of the position that our client was completely at fault for causing the accident.
