Dangerous currents, rip tides, large waves, and other water conditions
in ocean waters often cause injury and death to bathers. In fact, many
people associate swimming in oceans with injuries and drownings. The unfortunate
fact; however, is that drowning and injuries happen at other swimming
locations, especially at private and public pools.
Swimming pool drowning accidents frequently occur in every village, town,
city and state in the United States.
Experienced Poughkeepsie swimming pool accident attorneys read news reports of pool injuries and drownings every day.
In fact, there have been so many pool accidents and deaths in North Texas
this year, the summer of 2015 is being called the
“summer of drownings and near drownings”. The latest death involved a six-year-old child, last seen during daylight
hours but not pulled out of the water until after dark. The little girl
was swimming at an apartment complex pool with friends and family.
While some swimming pool deaths and injuries are unfortunate accidents,
others could have been prevented. In fact, some injuries and deaths happen
because of negligence and failure to adequately maintain property.
In total, more than a thousand children die every year when involved in
swimming-related activities. More than five thousand kids suffer injuries
short of death. The numbers are surprising but nonetheless true.
Let us talk about
swimming pool injuries caused by inadequate property maintenance. At swimming pools, common maintenance
issues relate to diving board defects and ladder defects. Walking surfaces
around the pool can be hazardous as well. If the swimming pool is publically
operated, the locker rooms and parking lots are known to be places where
unreasonably hazardous conditions exist.
Any hazard created by the pool owner/operator will trigger liability if
the hazard causes harm. The same holds true for other hazards; if the
owner knew or should have known about the hazard and failed to remediate
it or warn guests about the danger. Injuries sustained on account of the
hazard can cost the owner money.
Property maintenance aside, other things cause
deaths at swimming pools. For example, lack of proper supervision has been attributed to bather
death and injury. Lifeguards have been absent from bathing areas all together
and if present, the lifeguards can be improperly trained.
Swimming pool parties are especially dangerous. This is because of the
nature of the event. If the party is for children, the kids are typically
wound up and difficult to manage. If improperly supervised, injuries happen
quickly and it only takes mere seconds to drown. Adult pool parties often
involve alcohol, which never mixes well with swimming.
