On Thursday morning in Albany, a 4-year-old boy was struck and killed by
a garbage truck while attempting to cross a street hand-in-hand with his mother.
According to authorities, the accident occurred in a crosswalk at the intersection
of Central Avenue and Quail Street when a mother and child had just got
the go-ahead to cross from the traffic light and a garbage truck, turning
left onto Central from Quail street, struck the child.
Apparently the crossing guard that was assigned to that intersection, who
did not have her "stop" sign paddle because it was locked in
her car that had been towed, had just finished helping two pedestrians
on the other side of the street when the accident occurred.
The boy, whose named has not been released, was a pre-kindergarten student
at Philip Schuyler Achievement Academy and was described as "enthusiastic,
energetic and excited".
The ICS Waste and Recycling garbage truck was driven by Jim Kelly, a veteran
driver, who was on his usual route the consisted of collecting garbage
from commercial customers.
Charges have not been filed against Kelly.
Mainetti, Mainetti & O'Connor would like to express our deepest
sympathies to the friends and family of the child.
