Case Facts: A 62-year-old union laborer injured performing concrete construction resolved his case in Rockland Supreme Court recently, just prior to jury selection. Plaintiff had sustained a rotator cuff tear, biceps tendon tear and associated injuries to his shoulder, requiring surgery as well as injuries to his left knee including an ACL and MCL tear, requiring surgical repair.

Prior to trial the court granted Plaintiff’s motion for summary judgment against defendants, finding that appropriate safety devices and scaffolding was not provided the union laborer and caused his fall and injuries.

A settlement of $700,000 and the forgiveness of an additional $198,681.00 lien against Plaintiffs by defendants, resolved the case. The case was prepared and handled by Alfred Mainetti of Mainetti, Mainetti & O’Connor, P.C.
