Case Facts: Just before jury selection, a 65-year-old yard worker in Binghamton, N.Y., resolved his personal injury case against the tractor-trailer that backed into him for the sum of $2,025,000.00. The lengthy litigation involved three defendants. The rear passenger tires of the tractor trailer ran over Plaintiff’s right leg and buttocks, causing severe degloving injuries to Plaintiff’s right thigh and buttocks. Defendants claimed Plaintiff walked behind the truck as it was slowing to a stop while backing. Plaintiff said that he was clearing debris from the path of the tractor trailer as it backed to the location of the accident. There were significant disputes of fact between witnesses at the scene as to the occurrence. However, the owner of the tractor, the owner of the trailer and the driver all contributed to the settlement.

Plaintiff underwent multiple split skin grafts, coccyx fracture, sigmoidoscopy, colostomy, severe scarring, multiple infections and extensive muscle necrosis from the crush injury. He was hospitalized for 3 months and continued with medical care to the date of trial.

The settlement occurred just before jury selection and is believed to be one of the largest in Broome County. The case was prepared and handled by Alfred Mainetti of Mainetti, Mainetti & O’Connor, P.C.
