internal fixation. 29 days of confinement to hospital and rehabilitation
center. Plaintiff was unable to bear weight for a period of approximately
3 months and continued with physical therapy for an additional period
of approximately 4 months.
NOTE: Summary judgment under 240 of the New York State Labor Law was granted
