Case Facts: A settlement of $190,000.00 recently entered in Ulster County Supreme
Court for a husband and wife who were involved in a motor vehicle accident
in October of 2012 in Ulster County. As they were driving on a two-lane
country road Defendant’s vehicle came around a curve at a high rate
of speed hitting them head-on in their lane. Though photographs were taken
at the scene, the point of impact of the cars was questioned and difficult
to establish as Plaintiffs had limited recollection of the accident as
a result of the sudden nature of same as well as injuries.
Further testimony at pre-trial proceeding by Defendant did not concede
fault. Liability was established, however, when the deposition of two
witnesses traveling behind Plaintiff was completed and clearly established
the fault of Defendant operator.
Both husband and wife sustained multiple rib fractures and vertebral fractures
