Case Facts: The accident occurred when the defendant motorist, who was in the Hudson
Valley region on business driving a rental car, was distracted while utilizing
a G.P.S. device when he struck Plaintiff vehicle from behind. Plaintiff
brought suit against the defendant and the employer of the defendant driver.
Plaintiff was caused to suffer a whiplash type injury that caused cervical
pain leading to blurred vision as well as headaches, dizziness and other
visual changes. She treated with physical therapy for several months including
cognitive therapy for her visual changes.
The defendant in this case claimed that Plaintiff’s visual changes
were not casually related to the motor vehicle accident.
The matter was settled prior to jury selection and Plaintiff was awarded
$525,000.00 for pain and suffering. The case was handled by Joseph O’Connor
