Case Facts: October 8, 2007 on US Route 9W in the Town of Saugerties, County of Ulster
and State of New York. Plaintiff was driving his motor vehicle when he
came to a complete stop, moments after stopping he was struck from behind
by a vehicle driven by a teenager from Saugerties, NY.
Plaintiff was treated for complaints of neck and shoulder pain at the
Kingston Hospital and released within hours of the accident. Plaintiff
continued to suffer from pain and eventually exhausted all means of conservative
treatment including but not limiting to cervical injections, physical
therapy and spinal stimulation. Eventually Plaintiff was caused to suffer
a C-5 C-6 discectomy and fusion.
Prior to the accident Plaintiff was a 36 year old dance instructor. His
professional credits included but were not limited to MTV and numerous
regional dance events.
The defendant in this case denied that any of the injuries involved in
this accident were caused by the motor vehicle accident. Instead the defendant
hired a medical expert to testify that all of the injuries to the Plaintiff
were, in fact, pre-existing conditions.
During the litigation of the case the defendant refused to make any offer
of settlement to Plaintiff. Shortly before the jury rendered their verdict
there was an offer of $20,000.00.
The jury in this case awarded $200,000.00 in past pain and suffering and
$1,200,000.00 for future pain and suffering. The date of the verdict was
June 12, 2009 in Ulster County Supreme Court. The case was prosecuted
by Joseph E. O’Connor, Esq. of Mainetti, Mainetti & O’Connor.
