Riding at night, a biker finds himself on Main Street, Anytown, New York
where many taverns and clubs are hosting full crowds. The cool wind rushing
past the biker is invigorating. Then, without warning, an SUV runs a stop
sign and winds up in the path of the biker. Without enough time to react,
the biker collides with the SUV. He is catapulted through the side window
of the SUV, coming to a rest when his head collides with the interior
of the vehicles opposing door.
You should not be taken aback by this vivid story; it is not meant to be
Newburgh motorcycle accident attorneys know that these are exactly the types of accidents that can and do happen
to motorcyclists when vehicle drivers fail to follow the rules of the
road and breach their duty to other roadway users.
As you might suspect, the motorcyclist in the story above will have countless
injuries. He was capitulated through a glass window, so he will suffer
from numerous cuts. He will be bruised. Wearing a helmet may not prevent
him from head trauma or neck injury. He may end up with broken back vertebra,
fractured arms and legs, broken ribs, and many other injuries.
All of these types of
motorcycle injuries are considered to be serious. This should come to no surprise because
around eighty percent of all motorcycle accidents reported to authorities
leave the rider with a serious injury.
As mentioned above, the SUV driver breached his duty of care to the motorcyclist
when he ran through the stop sign. The law in Kingston, throughout the
Hudson Valley region, and everywhere in New York requires drivers to exercise
reasonable care when driving, as would anyone else, so that foreseeable
and preventable harm does not happen to others.
When this duty is breached, the offending driver has committed negligence.
If and when the victim is injured, and the injury was caused by the negligent
act, then the offending motorist can be held liable for damages in a Kingston
In addition to the injuries noted above, it is also common for motorcycle
crash victims to suffer:
- Road rash.
- Facial fractures.
- Spinal cord injuries.
- Traumatic Brain Injury.
- Nerve damage.
- Lost sensory functioning.
- Lost cognitive functioning.
For the lucky rider, some of these motorcycle injuries will be temporary.
But for others, the injury will be long term, persistent, and endure for
the rest of the rider’s life. This should illustrate that the victim’s
injury goes far beyond physical harm; the victim’s entire way of
life will be forever altered. Careers may be lost; recreational activities
never again enjoyed as they once were.
