Cranes hoist and lower various materials up to and down from the upper
levels of construction site buildings. Most commercial and even residential
construction sites will have cranes as regular fixtures on the premises.
So too are forklifts almost always present at construction sites. These
machines carry and transport loads too heavy for humans to carry without

The law in New York requires construction site owners, contractors, and
subcontractors to keep the worksite safe. Employers must ensure that their
equipment is properly used and properly maintained. They too must ensure
that their employees are properly trained in the use of construction equipment.
Failing at this is tantamount to negligence.
This type of negligence is unacceptable in New York. Construction workers
injured by cranes and forklifts can recover damages from the responsible
parties. This means that medical bills, lost wages, rehabilitation costs,
lost earning potential, and the like can all be returned to the victim.
Pain and suffering is compensable as well. Even the family of a deceased
laborer can receive compensation.
