Just a few weeks ago in Boston, a well-known criminal defense attorney was arrested and charged with
negligent operation of a boat, causing serious bodily injury while operating
a boat under the influence of alcohol, in addition to another charge.
Authorities report that his blood alcohol content was above the limit proscribed
by law for people operating watercraft. The injury he allegedly caused
is horrendous. A female passenger was attempting to climb into the boat
when her arm was severed by the boat’s propeller.
It is certainly disappointing to see a member of the legal profession behaving
in such a manner.
Our experienced personal injury Newburgh attorneys take the profession and the law seriously and find such criminal and negligent
Celebrating the holiday weekend on the water should be a fun and safe experience.
However, if a person is injured by the negligent acts of another while
on the water, New York laws give the victim rights to sue the offending party.
Boating while intoxicated is not only dangerous and deadly. Just like in
Massachusetts, it is illegal in New York. The laws exist for a reason;
to keep people safe and to hold offenders accountable. Some boaters still
have not gotten the message.
Most years see almost five thousand boating accidents. Over three thousand
injuries happen in boating accidents annually and around seven hundred
people are killed in these accidents.
Often times people do not take boating as seriously as driving. They think
it is all about fun and sun. Having fun is fine, but not at the expense
of people’s safety. Reckless, wanton behavior, drunk boating, failing
to follow speed rules and wake rules, not having safety equipment, having
too many passengers on board, and or allowing under age people to pilot
the vessel are all examples of negligent acts that can lead to a law suit.
The negligent operation of a boat, such as piloting a boat while drunk
do more than ruin reputations and careers; it ruins the lives of victims
and their families.
