Jonah quickly approached a red light at the end of the highway off ramp.
He was in a rush to get to the bank for his first day of work. A quick
left turn and the bank is just a mile down the road he thinks to himself;
except the traffic signal making the quick left turn – let us say
– is not so quick.
The twenty-five year old man plays with his satellite radio while waiting.
A quick glance up and he sees the light change from red to his favorite
color green. Without thinking he quickly accelerates but comes to a sudden
halt with the crunch and crackle of metal and glass bending and breaking.
Jonah forgot an important fact about his wait at the traffic signal. Another
vehicle was stopped at the light just in front of him! When he saw the
light change, he just gunned it while the car in front of him barely had
a chance to start moving.
Experienced Poughkeepsie car accident attorneysknow that rear-end collisions such as the one caused by Jonah is just one
of many common roadway accidents that occur in and around the Hudson Valley
regions of New York. Other common causes of car accidents include negligent
left hand turns, drunk driving, distracted driving, speeding, drowsy driving,
tailgating, and various other failures to obey traffic regulations.
Suing the offending driver for compensation is a valid way to receive recompense
for unpaid expenses caused by the
car accident – pain and suffering can also be claimed.
The legal theory upon which one will base a claim is negligence. A compensable
claim for negligence arises when one owes a duty to another and then breaches
that duty to the extent that the victim is caused to suffer injury and damages.
The duty owed by motorists is that of reasonable care when driving, as
would be used by any other prudent motorist, so that others are not injured.
It appears that Jonah may have committed negligence. We know he has a duty
because all drivers do. Without paying attention, and failing to see what
could be seen, he accelerated and plowed into the car in front of him.
While we do not know if the victim suffered injury, these types of accidents
can easily cause whiplash, back injury, and spinal injury. These injuries
are very painful and can endure for lengthy periods. Many victims of these
injuries lose wages from missed work and have to pay out of pocket for
various medical and rehabilitation bills.
So long as the person hurt by Jonah sues for compensation before the statute
of limitations expires – three years in New York for private actors
– these losses can be recovered.
