Perhaps the one category of car accident that has an almost limitless list
of contributing factors is the rear end motor vehicle collision. Of course, our
experienced New York City motor vehicle accident attorneys have seen that tail gating, driver inattention, and driving under the
influence of drugs and or alcohol are some of the more likely suspects
that which contribute to a rear end collision.
Driver inattention happens in many ways. The offending motorist could be
playing with the car radio, leaning over to pick up an object from the
floor, and or when reaching into the back seat. Of course cell phone use
and texting leads to driver inattention.
car accidents also often occur because the rear driver simply did not have enough time
to slow down or stop before colliding with the front vehicle. This can
be due to driver inattention, tailgating, driving too fast, operating
a vehicle with inadequate breaking capabilities, and the like. Of course
weather conditions can lead to rear end collisions. In these instances
it is easy to blame the weather, but one also has to ask if the rear driver
was driving inappropriately given the weather conditions.
Another likely contributor to
rear end collisions is driver intoxication or impairment from drugs. This is simply because
alcohol and drugs impair one’s motor and cognitive functioning.
This means that the impaired driver is either too slow to respond to stimuli
or simply fails to perceive external stimuli. Of course this also means
that the impaired driver simply might not have the physical ability to
avoid a collision even if the offending driver did see the danger coming.
Other common contributors to rear end collisions are:
- Road defects and or hazards;
- Other accidents;
- Disabled vehicles on the road;
- Pedestrians running into the road; and
- Inclement weather.
Rear end collision injuries are especially painful and will affect all parts of the victim’s
body. Even though air bags and seat belts save lives, they can also injure
the driver when a crash occurs. Airbags deploy at a very high rate of
speed and they are not the softest type of woven material. Airbags can
break facial bones and cause burns to a driver’s face. When seat
belts lock to save a person from vaulting forward into the windshield,
the force may easily bruise the driver and even cause the driver’s
ribs to fracture.
As you know, when the human body is suddenly stopped and or violently moved
around, the shoulders, neck and spine can become hyper extended or flexed.
This is called whiplash. Whiplash is very serious and the victim can have
pain for weeks, months and even years.
