You have fallen. You are on the ground and most likely injured. The confusion
starts now. Many slip and fall victims are confused from the moment they
began to fall. Slip and fall accidents are nothing to joke about and it
is normal to be confused and wonder what to do after the fall occurred.
Experienced Poughkeepsie slip and fall accident attorneys impart to these victims one simple bit of advice: protect yourself. This
means protect yourself by immediately taking care of your medical needs
and protect yourself in legal terms.
Look, we know that falling can be embarrassing, but such should not prevent a
slip and fall victim from seeking medical attention. Even minor falls can cause serious fractures
to the hands, arms, facial bones, ribs, and so on. What initially seemed
like a minor blow to the head can actually have caused serious injury,
such as a concussion.
Seeking medical care does more than just repair a broken body. It documents
that an injury actually occurred; the time, place, date, etcetera. Medical
records will also document the costs of medical care attributed to the
slip and fall accident injury.
Again, we know that a slip and fall can be embarrassing, but the accident
must be reported to the property owner or those persons in charge of the
property. If the fall occurred at someone’s home, notify the homeowner.
If one falls at a store, notify the manager and or owner. Accident reports
are routinely taken at businesses when accidents happen. Such is another
type of evidence documenting the accident’s occurrence.
The injured victim should also get the property owner’s name, manager’s
name, and the owner’s/operator’s property insurance information.
Be polite, but do not say too much. Some people are very savvy and will
try to trick victims into admitting personal fault or some other type
of damning statement.
Who else should the victim talk to at the accident scene? Other people
who may have witnessed the accident and or observed the dangerous condition
that caused the victim to
slip or trip and fall. Take photos of the area (another good thing about the smart phone invention!).
The injured victim could even take notes.
Keep all of the above mentioned documentation in a safe location so that
it can be used at trial. Do not get rid of anything that an attorney can
use to help protect your legal right to compensation. Therefore, after
seeking medical attention you should contact an experienced attorney.
In the meantime, be wary of calls from the property owner’s insurance
carrier. They will attempt to limit their exposure and can be manipulative.
Let your attorney do the talking for you.
