Many people take
slip and fall accidents as being an ordinary fact of life; simply, it happens and will continue
to happen and nothing can be done to change it. Nothing could be further
from the truth. No slip and fall victim should simply accept what happened.
Experienced Newburgh slip and fall accident attorneys know that accident victims have rights. Specifically, people who are on
the property of another have a right to be kept safe and warned of possible
danger. Also, if the property owner and or operator negligently maintained
the premises, that owner and or occupier can be held responsible for the
Chances are likely that you will be injured while on someone else’s
property. If you take time to think about it, much of our activity each
day occurs off of our own property. So, what should you do if you are
injured in a
slip and fall accident?
Once the accident occurs, check your body for injuries. Don’t worry
about getting up from the ground right away. I know, the situation can
be embarrassing and you will probably want to flee right away. But your
injuries can be severe, in fact that could be more severe than you initially
realize. So take a moment to gain your bearings and realize the extent
of your injuries.
Also, don’t be afraid to ask for help; whether from a passerby or
from an employee. Use your cell phone to call for help if no one else
is around. Call 911 if the injuries are serious enough to warrant such.
Otherwise, get yourself to a doctor as soon as possible. Remember, some
injuries don’t come with immediate signs of the problem and only
an examination can reveal the injury.
Never leave the
slip and fall scene without notifying the property owner and or person in control of
the location. If this is a business, notify the manager; if a residence,
notify the property owner and or landlord. Make sure the business operator
fills out an accident report and request a copy. Again, if at a residential
location, find out who insures the property and notify that carrier about
the accident. Note, however, it is always better to have an experienced
attorney contact insurance companies on your behalf.
Probably the hardest part and the thing most likely to be ignored is the
collection of specific data; for example, the names of witnesses, the
date, time and location of the incident. Copies of accident reports should
be obtained as well. Medical records should be retained as well.
Of course, if you haven’t contacted an attorney, you should do so
as soon as possible after the accident occurred. Experienced slip and
fall attorneys can help you get through every phase in consequence of
a slip and fall accident.
