Air travel is complex and can sometimes be quite difficult. Planning the
summer flight, negotiating through the airport, and claiming baggage is
anything but routine. On top of these issues is anxiety; worry about delays and
accidents. Airplane passengers are all too aware that airplane crashes are unique
and surviving a crash may not be likely.
Experienced Newburgh airplane accident attorneys are familiar with the common causes of plane crashes. Our experience has
seen cases when bad weather has caused an accident. Of course there are
issues of maintenance errors or omissions, pilot errors, engine failures
and various FAA violations. Poorly designed air craft have caused accidents
too. Turbulence can
cause accidents and injuries. Runway incursions are a known plane crash cause as well.
When something on the ground or runway causes an accident, it is called
a runway incursion. People, objects, other aircraft, and other vehicles
have been the source of a runway incursion. Pilots are trained to be aware
of these issues, so have been support personnel and traffic controllers.
Any of these people can be responsible for the accident.
Pilots themselves, plane manufacturers, air plane carriers, and other flight
related staff owe air passengers a duty to keep them safe. They are trained
to keep passengers safe and at the same time regulations exist to enhance
Federal Aviation Administration is charged with enforcing flight related regulations.
Hopefully a breach is detected before an accident occurs; but such will
not always happen. When any of the above mentioned parties violates a
regulation and or breaches their duty of care, the injured passenger has
a right to commence civil litigation; a law suit to recover lost damages.
Plane accidents are thoroughly investigated by numerous agencies and errors
are discovered. The FAA, TSA and even the FBI will investigate and report
on the causes of the air plane crash. These investigations may serve to
help the injured passenger prove negligence.
Even if the passenger died in the accident, family and estate administrators may
sue the negligent parties via wrongful death and survival actions. This way, negligent plane manufacturers and or airline companies can
compensate the victim’s family and the victim’s estate for
damages resulting from the negligently caused air plane crash. It doesn’t
matter if the air craft was a jet liner, single engine craft, or helicopter;
the victim’s rights are the same.
In closing, our experience shows us that place accidents are extremely
traumatic. Lawsuits are not designed to relieve trauma or grief. So please
note that many agencies provide emotional support to victims and family
members. FEMA, the American Red Cross, the NTSB, and even the FAA can
offer help and provide direction.
